OVERVIEW

Welcome to Siora PK. The terms “we”, “us” and “our” refer to Siora PK. We operate this store and website at siora.pk, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).

These Terms of Service, together with any policies referred to in them, govern your access to and use of the Services. By visiting our site or buying something from us, you agree to these terms. If you do not agree with them, please do not use the Services.

We may update these terms at any time. The version published on this page is the one that applies. Your continued use of the Services after a change means you accept the updated terms.

SECTION 1: ELIGIBILITY

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By placing an order you confirm that the information you give us is accurate and that you are authorised to use the payment method you provide.

SECTION 2: PRODUCTS AND PRODUCT INFORMATION

We sell skincare products. We take care to describe our products, their ingredients and their intended use accurately, and to photograph them faithfully. Even so, colours and textures can appear differently on different screens, and packaging may change between batches.

Availability is not guaranteed. We may limit quantities, discontinue a product, or correct an error in a description, price or image at any time without notice.

SECTION 3: SKIN SAFETY AND PERSONAL USE

Our products are cosmetics, not medicines. Nothing on this site is medical advice, and nothing we publish should be treated as a diagnosis or a treatment plan.

Please read the ingredient list and directions before you use a product. We recommend a patch test on a small area of skin before first use, particularly with active ingredients such as salicylic acid, vitamin C or retinoids. Stop using a product and seek medical advice if you experience irritation, a rash, swelling or any other reaction. If you are pregnant, breastfeeding, or under the care of a dermatologist, check with a qualified professional before adding a new product to your routine.

Any skin analysis, quiz or recommendation tool offered on our site is a guide based on the information you give us. It is not a clinical assessment, and results will vary from person to person.

SECTION 4: PRICES AND PAYMENT

Prices are shown in the currency displayed at checkout and may change without notice. The total payable, including any delivery charge and applicable tax, is shown to you before you confirm your order.

We must receive and process your payment before an order is accepted. If payment fails, is reversed, or is flagged by our payment provider, we may cancel the order.

SECTION 5: ORDERS AND ACCEPTANCE

When you place an order you are making an offer to buy. Siora PK may accept or decline any order at its discretion, and your order is not accepted until we confirm it. Please review your order carefully before you submit it, because we may be unable to change or cancel it once it has been accepted.

If we cannot accept or fulfil your order, in whole or in part, we will let you know and refund any amount you have already paid for the part we cannot supply.

SECTION 6: DELIVERY

Delivery options, charges and estimated timeframes are shown at checkout. Estimates are not guarantees. Once an order has been handed to a courier, delivery timing is in their hands.

Please give a complete and correct delivery address. We are not responsible for an order that cannot be delivered, or is returned to us, because the address or contact details you supplied were wrong or incomplete.

SECTION 7: RETURNS AND REFUNDS

Returns, exchanges and refunds are governed by our Refund and Return Policy, which forms part of these terms.

SECTION 8: INTELLECTUAL PROPERTY

All content on the Services, including text, product descriptions, photographs, graphics, logos, video and audio, and the design, selection and arrangement of that content, is owned by Siora PK or its licensors and is protected by copyright, trademark and other intellectual property laws.

The Siora PK name, logo and product names are our trademarks. You must not use them without our prior written permission. Nothing on the Services grants you a licence or any other right to our intellectual property. All rights not expressly granted are reserved.

You may view, download and print content from the Services for your own personal, non-commercial use. You must not copy, republish, sell or otherwise exploit it for any other purpose.

SECTION 9: ACCEPTABLE USE

You agree to use the Services only for lawful purposes, and not to use them in a way that restricts or inhibits anyone else’s use or enjoyment of them, or that may harm Siora PK, our suppliers or other users. In particular, you agree not to:

(a) upload or transmit any virus, malware or other harmful code;
(b) attempt to gain unauthorised access to the Services, any account, or any system or network connected to them;
(c) scrape, crawl, copy or harvest content or data from the Services by automated means without our written consent;
(d) interfere with the security or proper working of the Services;
(e) post or send anything unlawful, abusive, defamatory, obscene, misleading or infringing;
(f) impersonate any person, or misrepresent your identity or affiliation; or
(g) use the Services to send unsolicited commercial messages.

We may suspend or refuse access to the Services, and cancel orders, if we reasonably believe you have breached these terms.

SECTION 10: REVIEWS AND SUBMISSIONS

If you send us a review, photograph, comment or any other material, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt and publish it in connection with our business. You confirm that the material is your own, that it is accurate, and that it does not infringe anyone else’s rights. We are not obliged to publish any submission, and we may edit or remove one at any time.

SECTION 11: THIRD PARTY LINKS AND SERVICES

The Services may link to websites, tools or content operated by others. We do not control them and we are not responsible for their content, their products or their privacy practices. Please review the terms and policies of any third party site before you use it.

SECTION 12: RELATIONSHIP WITH SHOPIFY

Siora PK is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Siora PK. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Siora PK, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Siora PK.

SECTION 13: DISCLAIMER OF WARRANTIES

Except as expressly stated by Siora PK, and except for any rights you have under applicable consumer law that cannot be excluded, the Services and all products offered through them are provided on an “as is” and “as available” basis, without warranty of any kind, whether express or implied.

We do not warrant that the Services will be uninterrupted, secure or error free, that defects will be corrected, or that any particular result will be achieved by using a product. Individual results from skincare vary.

SECTION 14: LIMITATION OF LIABILITY

To the fullest extent permitted by law, Siora PK, our directors, officers, employees, agents, contractors, service providers and licensors will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, data or goodwill, arising out of or in connection with your use of the Services or any product bought through them, even if we have been advised of the possibility.

Where liability cannot be excluded, our total liability to you will not exceed the amount you paid for the order giving rise to the claim. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law.

SECTION 15: INDEMNIFICATION

You agree to indemnify and hold harmless Siora PK, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors and licensors from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these terms or your misuse of the Services.

SECTION 16: PRIVACY

All personal information we collect through the Services is handled in accordance with our Privacy Policy.

SECTION 17: SEVERABILITY AND WAIVER

If any provision of these terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in force. Our failure to enforce any right or provision does not waive that right or provision.

SECTION 18: GOVERNING LAW

These Terms of Service, and any dispute arising out of them or out of your use of the Services, are governed by the laws of the Islamic Republic of Pakistan. You and Siora PK agree to the exclusive jurisdiction of the courts of Pakistan.

The headings in this agreement are included for convenience only and do not limit or affect the terms themselves.
